ISLAMABAD: The Islamabad High Court (IHC) has been urged to declare the dismissal of Dr Rizwan Ullah and Dr Ali Mujtaba from the Burn Surgery Programme at the Burn Care Centre of the Pakistan Institute of Medical Sciences (PIMS), Islamabad, as void ab initio and without any legal effect.

Dr Rizwan Ullah and Dr Ali Mujtaba, on Wednesday, filed a petition before the IHC, naming the Executive Director of PIMS, the Federation through the Ministry of National Health Services, Regulations and Coordination, and Dr Abdul Khaliq, in charge of the Burn Care Centre (BCC), as respondents.

The petitioners are young doctors and duly enrolled students currently pursuing the MS Burn Surgery Program at the Burn Care Centre, PIMS. They were granted admission by Shaheed Zulfiqar Ali Bhutto Medical University on 19.12.2022 and 07.01.2021, respectively. Pursuant thereto, they were placed at the Burn Care Centre, PIMS, for clinical and practical training as part of the said MS Burn Surgery program.

The petitioners alleged that they were removed, vide order dated 09.05.2026, from the Burn Surgery program at the Burn Care Centre, PIMS, because they had filed a writ petition (4170/2025) before the High Court against the Respondents.

They contended that the impugned dismissal order is malafide in nature and appears to have been passed as a retaliatory measure and counterblast to the writ petition.

They argued that the dismissal orders, along with all consequential actions, including the hostel vacation notices, are illegal, void ab initio, and of no legal effect; and needed to be set aside.

The petitioners prayed the IHC to direct the respondents to reinstate them to the concerned Department and restrain them from harassing them.

They also asked the Court to direct Respondents No. 1, 3, and 4 to permit and facilitate the peaceful entry of the petitioners to the concerned Department, to enable them to complete their training. Direct the respondents to reinstate the stipend of the Petitioners from the date of their unlawful dismissal, they further prayed.
