Justice Sheikh Azmat Saeed of Lahore High Court here Friday referred two petitions against former dictator General Pervez Musharraf (Retd) to the chief justice for constitution of a larger bench, seeking prosecution on the charges of high treason.
Earlier, the petitioner's counsel, A. K. Dogar, informed the court that a petition against the Prime Minister has already been referred to the CJ for constitution of large bench and the instant one might also be sent as certain constitutional and legal issues are involved in it. The judge accepted his request and sent the case to the CJ.
The petitioner, Rana Ilam-ud-Din Ghazi, had levelled 15 allegations of different nature against the former army chief. He argued that the former army chief had sabotaged the constitution, violated his oath and dissolved the elected government without any cogent reason, only to save his skin, and came to power illegally. He submitted that Musharraf violated the constitution as judges of the Supreme Court and four high courts were prevented to perform their judicial work and Chief Justice, Iftikhar Muhammad Chaudhry was detained along-with his children.
General Musharraf also compelled Dr Abdul Qadir Khan to accept the allegation for selling nuclear technology, which earned a bad name for the country. He further claimed that during the regime of former president, "thousands" of Hafiz-e-Quran girls and boys were killed through phosphorus bombs during an operation in Jamiah Hafsa, Islamabad. Musharraf ordered the murder of "patriot" Muhammad Akbar Bugti and also threatened his family members to leave the country or die.
The former general also joined US war after 9/11 without a consent from the nation and handed over the innocent citizens from Muslim country to America to complete their nefarious designs. He also made a plan to kill Benazir Bhutto. He stated that according to the statement of Chaudhry Shujaat Hussain, President Pakistan Muslim League (Q), Musharraf also committed a series of heinous crimes. He requested that the federal government should be directed to bring General Pervez Musharraf (Retd) in the court. He prayed to the court to take cognisance of these offences against the former general and direct the Cabinet Division for his extradition and put him to trial on high treason charges under Article 6 of the constitution. Aziz Ahmad Awan, Secretary General, Tameer-e-Pakistan Party, through his counsel S. N. Khawar, had moved the second petition.
