The Chief Justice Iftikhar Muhammad Chaudhry constituted six benches including a larger one to hear high profile constitutional cases next week in Islamabad where presidential reference seeking SC opinion on revisiting the execution of Zulfiqar Ali Bhutto will also be heard.
On Monday (tomorrow), a larger bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Javed Iqbal, Justice Mian Shakirullah Jan, Justice Nasir-ul-Mulk, Justice Muhammad Sair Ali, Justice Mahmood Akhtar Shahid Siddiqui, Justice Jawad S. Khawaja, Justice Anwar Zaheer Jamali, Justice Khilji Arif Hussain, Justice Sarmad Jalal Osmani and Justice Ghulam Rabbani shall resume hearing of the presidential reference.
The reference was filed by the President of Pakistan under Article 186 of the Constitution to revisit the case of Zulfiqar Ali Bhutto. The SC had directed Punjab Home Secretary and Federal Interior Secretary to produce a copy of the document under which Bhutto was arrested despite being granted bail by the High Court (under Martial Law regulation number 12), the Court had also directed the Attorney General for Pakistan to present Justice Shafiqur Rehman's report before the court, on the basis of which Bhutto was hanged. The Federation's counsel Dr Babar Awan will deliver argument in the case.
Besides the larger bench, the CJP constituted five benches of the Supreme Court. One bench would be headed by the Chief Justice himself, comprising Justice Muhammad Sair and Justice Ghulam Rabbani, while the second bench would comprise Justice Javed Iqbal, Justice Anwar Zaheer Jamali and Justice Khilji Arif Hussain. Bench III would be headed by the Justice Mian Shakirullah Jan, comprising Justice Mahmood Akhtar, Shahid Siddiqui and Justice Sarmad Jalal Osmani. It is worth mentioning that all the benches are subject to hear the cases after larger bench proceedings.
