India's Home Minister Amit Shah moved a proposal in the Indian parliament on Monday to revoke the Article 370 from Indian occupied Kashmir (IoK).

Shah's proposal caused a massive chaos in the Parliament by the opposition, who chanted slogans and started protesting. Article 370 of the Indian constitution gives special status to the state of Jammu and Kashmir. However, after the Indian president's nod, the special status will be revoked.

Earlier, Prime Minister Narendra Modi held a crucial Cabinet meeting at his 7 Lok Kalyan Marg residence along with the other members of the Cabinet Committee on Security (CCS). Addressing the Parliament after the meeting, the minister moved a proposal to revoke the contentious Article 370 from IoK.

 

 

Under the proposed law by the home minister, Jammu and Kashmir will now be a Union Territory with legislature and not a state. While, Ladakh will now be a Union Territory without legislation.

Article 370

Article 370 was included in the Constitution on October 17, 1949. Under Article 370, temporary provision is provided to the state of Jammu and Kashmir, granting it special autonomy. All the provisions of the Constitution which are applicable to other states are not applicable to occupied Kashmir.

This means the residents of IoK, live under a separate set of laws. The article allows only residents to buy property and hold state government jobs. Therefore, Indian citizens from other states cannot purchase land or property in IoK. The article also restricts Parliament’s legislative powers in respect to Jammu and Kashmir.
