A prominent lawyer Dr Abdul Basit on Monday said charge-sheet against the Prime Minister, framed under Ordinance 2003, was not valid as the same Ordinance had already been rejected by 17-member bench of the Supreme Court.
Explaining his point, he said that the Ordinance 2003 was promulgated by a dictator was not approved by the 17-member Bench of the Supreme Court, while taking up the matter some time ago.
He said, "How a charge sheet was issued under Ordinance 2003, which is not a live law. I had raised the same point in the PCO judges case", pointing out that the said law was not given validation by the Parliament as well, Dr Basit said while talking to media in the Supreme Court premises after the hearing of the contempt of court case against the Prime Minister.
Responding to a question, whether the court can direct the Attorney General to write a letter to Swiss Courts, he made it very clear that the Attorney General could not write a letter.
If the Attorney General would write the same, then it would not have any validity. He is only a chief law officer, and not government, he added.
