Supreme Court of Pakistan on Friday directed Attorney General Moulvi Anwarul Haq to seek instructions from concerned quarters to expedite arrest of the accused persons involved in cases of terrorism, targeted killings, extortion collection, etc in Karachi.
The larger bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Anwar Zaheer Jamali, Justice Sarmad Jalal Osmany, Justice Ghulam Rabbani and Justice Amir Hani Muslim has been hearing a suo motu case on killings in Karachi.
Attorney General Moulvi Anwarul Haq in pursuance of the order passed on August 24, 2011 placed on record report form Intelligence Bureau on investigation into targeted killings in Karachi. Advocate General Sindh Abdul Fattah Malik submitted a summary of cases relating to extortion, kidnappings and targeted killings in acts of violence that took place from July 24 to August 24 in Karachi.
According to him, on September 8, 2011 the body of a Pakhtoon Students Federation activist was found from Sachal area, in which complainant had nominated Ahmed Shah, Omair Siddiqui and Liaquat Qureshi allegedly belonging to student outfit APMSO as accused.
He said the same day the body of a Chartered Accountant was found in JPMC, Karachi, while a decomposed body of an unidentified man was recovered from Pakistan Bazaar area, Orangi. Additional DIG Saud Mirza said progress was likely to be made in a murder case of Advocate Fahimul Kareem and two others. Investigation officer did not make disclosure.
The Chief Justice said two persons wrongly nominated in case relating to an armed attack on bus carrying policemen in Chakra Goth were released. He inquired from IGP Wajid Ali Durrani about the action the police are taking as the number of such cases is still on the rise. What concerned SHO did in this (Chakra Goth bus attack) case and what action was taken against SHO, the CJP further asked.
Additional DIG Saud Mirza informed the court that Investigation Officer had been suspended and an inquiry entrusted to another official. Responding to a question that why only Investigation Officer was suspended and no action was taken against concerned SHO raised by Justice Amir Hani Muslim, ADIG, Mirza submitted that he had no powers to suspend a DSP since Police Order 2002 stood abolished following the revival of Police Act 1861.
The Chief Justice observed: "All forces got active only when the bench came to Karachi but still bodies are being found in city, where all political parties, PPP, MQM, ANP and others, claim that they want peace in Karachi." The SC bench said on court order overnight arrest was made of the accused in the kidnapping and murder case of applicant Ms Surraiya's son. He asked why no action was taken before court's intervention. It was informed that this case was in fact a dispute of Hallala.
Directing the concerned SSP concerned to submit a comprehensive report in court, the Chief Justice remarked that all cases of extortion, kidnapping and murder were being disposed of by police as 'A' class. IG Durrani admitted that 30 to 50 percent officers were sympathisers of political parties, which hampers action against criminals. These political people are deceiving us, according to him. However, action is being initiated against those officers whose political affiliations have been determined.
IG Durrani said while investigating crimes there were hurdles in getting requisite information from mobile companies as well as evidence from banks in respect of ATMs, etc. He said ISI had facility of GSM/RBS locators, but the federal government fears that police will misuse this facility.
The Chief Justice ordered: "He (IGP Sindh) is directed to submit such problems in writing, a copy whereof, will be handed over to the Attorney General to seek instructions from the concerned quarters to expedite arrest of accused persons involved in terrorism, targeted killings, bhatta collection, etcetera, in Karachi. The learned Attorney General for Pakistan shall submit report on the next date of hearing." Chief Justice also directed respondents in Constitutional Petitions No 60 & 61 of 2011 be directed to file para-wise comments as these petitions are likely to be taken up during next week. For further arguments, SC bench adjourned the hearing till September 13, 2011 when matter will be taken up at Karachi.
