The Lahore High Court (LHC) here on Thursday issued notices to Punjab government, Lahore Development Authority and Parks and Horticulture Authority for March 02 and sought their replies to a petition challenging establishment of Liberty Park and Ride Shopping Plaza at Liberty Market, Lahore.
Judicial Activism Panel (JAP) Chairman Muhammad Azhar Siddique and six shop owners at Liberty Market filed the petition and contended that the transfer of open space to LDA for the purpose of constructing the plaza was illegal and in violation of the fundamental rights enshrined in the constitution.
They said the government and PHA, had no authority to go into business other than those prescribed in the Acts, Regulations and Rules and prayed to the court to cancel all the notifications issued by the PHA and the Punjab government purporting to transfer the said open space to LDA. They prayed to the court to declare that the said open space was still in the ownership and control of PHA and that all subsequent transactions or transfers of it by any authority was without any legal jurisdiction.
