Three-fourth majority cannot be challenged: 19th Amend bill draft approved by parliamentary body
The draft of the 19th constitutional amendment bill, which has been approved by the Parliamentary Committee on Constitutional Reforms, will be tabled in National Assembly today, according to Aaj News.
The Parliamentary Committee has complied with the recommendations of the SC by enhancing the strength of SC judges in the Judicial Commission from two to four and now the four senior-most judges of the Supreme Court, besides Chief Justice of the Supreme Court, would be the members of the committee.
With the approval of the proposed amendment, the total strength of the Judicial Commission would go up to nine from seven, as Judicial Commission would now comprise the Chief Justice of Pakistan, four senior-most judges, one retired judge of the Supreme Court, Law Minister, Attorney General for Pakistan and a nominee of the Pakistan Bar Council.
According to the draft of the amendments, if the nomination of a judge is rejected by the Parliamentary Committee with a three-fourth majority then the judicial commission would not be able to re-send the same name to Parliamentary Committee.
The channel said that as per the proposed amendments, the committee would send its recommendations to the Prime Minister and Prime Minister would refer it to the President for his assent. According to the channel, the committee has also suggested amendment to Article 81, 213 and 246 which are related to constitution of Islamabad High Court, appointment of Chief Election Commissioner and administrative control of tribal areas bordering Tank and Lakki Marwat, respectively.
