Justice Ijaz ul Ahsan passed the order on an application filed by Muhammad Azhar Siddique advocate in his already pending petition seeking implementation of pubic transport laws.
The court during hearing observed that it was a matter of precious human lives and court would thoroughly look into it.
The court also directed the Punjab government to implement in letter and spirit the laws of Motorway police and public transport to avert recurrence of such accidents.
Earlier, the petitioner-counsel pleaded that criteria laid down in the Punjab Motor vehicle ordinance, 1965 and Motor Vehicle rules 1969 was not being fulfilled by transporter mafia and the provincial transport department which was causing tragic accidents such as that occurred at Kallar Kahar.
The petitioner requested the court to give directions for constituting a judicial commission or high powered committee by the government for ascertaining the reasons of the tragic accident. He said the judicial commission should examine percentage of the defective vehicles plying on roads and pass recommendations to make necessary amendments in the statutory laws to regulate transport vehicles.
He said the laws about regulating public transport had become redundant as either they were not applied or to the extent of paper work only. He said on the roads there was no check on defective buses plying without fitness certificates.
The petitioner said criminal cases be registered against those responsible for the fatal accident at Kallar Kahar which resulted in loss of lives of 40 school children.
He said the school bus, which met accident in Kallar Kahar, was overloaded and and it had defects which could not be permitted to ply on Motorway.
He pleaded directions be issued to government for executing a computerized MIS system to control, monitor and regulate the public transport including registration of vehicles fitness, licenses of drivers and different documentations about entry and exit of vehicles from the city.
