The Supreme Court on July 31, 2018 had set aside the appointment of Cyan as CEO of the national flag carrier on grounds that his elevation to the post was against rules and procedure, saying laws were not followed in the appointment of Cyan as PIA CEO.
The Registrar had raised objection, "The subject HRC application has been examined, scrutinized and found to be not entertainable under Order X Rule 2 of Supreme Court Rules 1980".
The petitioner contended that justice should not be denied to a person on such flimsy grounds. To obstruct the Appellant from filing the above application is tantamount to denying him the very right to seek justice and to properly defend himself and that too against an order which was bereft of jurisdiction.
The office while returning the application has not examined the case objectively but rather subjectively which amounts to travesty of justice. The matter brought before the court is of public interest which requires adjudication by this court, said the petitioner.
