SC wants clear stance on holding of elections in Cantonment Boards

A three-Judge bench of Chief Justice Iftikhar Muhammad Chaudhry, Justice Gulzar Ahmed and Justice Sh. Azmat Saeed resumed hearing of a constitutional petition.

 

During course of hearing, Commander Shahbaz Hussain, a representative of the ministry, apprised the bench that they had moved summary under the laws to the Prime Minister, and after his approval they would forward it to the Election Commission of Pakistan for holding elections in the boards.

 

The Chief Justice observed that under Article 148, holding of elections was the duty of the ECP.

 

Shahbaz said that the Rules were framed under the Ordinance of Local Government of 2002.

 

He said under the said provision, the ministry could not address the ECP directly and it was the federal government which would have to take action.

 

To bench's query, he replied that they were granted extension by the competent authority till May 5, 2013 regarding continuation of the current set up.

 

The bench directed deputy attorney general Dil Muhammad Alizai to come prepared and apprise it with definite stance of the government.
