Contempt petition: SC directs DCs to file reports on land encroachment

A two-judge bench headed by Justice Umar Ata Bandial heard Nayyab Umrani contempt petition against the DCs of the said districts for not complying with the apex court order.

The bench ordered the DCs of these districts to submit separate reports about the alleged properties.

Former chief justice Mian Saqib Nisar on 8th October, 2018 before disposing of suo motu had directed the concerned authorities to file detail of the properties, claimed by the petitioner.

Nayab Umrani had filed a petition in July, 2018, wherein she alleged that her entire family was murdered in a series of attacks in 2015 in Sindh and Balochistan, and on May 31, 2018, her elder sister, who was a lawyer by profession and fighting her brothers' murder case, was also killed by the same people.

During the proceeding, Justice Bandial noted that no progress has been in the case, while the authorities were directed to file progress report. He said the petitioner was forced to live in Islamabad for the last two years due to threats of encroachers.

Nayab Umrani, in her contempt petition, claimed that the concerned authorities have not implemented the apex court orders. She said that her father had five wives, adding out of them four are Baloch, while her mother is Punjabi.

She informed that the apex court had directed the DC to constitute a commission for selling the properties. The petitioner informed that DC Jacobabad has created hindrance in the implementation of the court orders.

The court observed that 3.25 acres land in Jacobabad has many co-sharers. He said that without hearing other sides, they cannot decide the matter. Justice Umar Ata Bandial said earlier they had grant stay in this petition. He said that ultimately the civil court has to decide the matter.

The AAG informed that earlier the petitioner had land dispute in Naseerabad. Justice Bandial directed the AAG to ask the DC to bring land record on the next date of the hearing.

The court ordered the DC Jacobabad collect the record of all the properties and take possession of land, and to file report whether its orders were complied with or not?

The case was adjourned for one month.
