SC continues hearing case regarding FGEHF

ISLAMABAD: A three-member bench of the Supreme Court headed by Justice Mushir Alam and comprising Justice Faisal Arab and Justice Ijaz Ul Ahsan on Tuesday continued hearing heard the case regarding Federal Government Employees Housing Foundation (FGEHF).

During the course of proceedings, the counsel for FGEHF said the laws of Capital Development Authority (CDA) did not imply on the land which had not been acquired.

Faisal Naqvi, counsel for the victims, said according to CDA Act of 1992, only the civic body could acquire land in the capital.

Justice Ijaz Ul Asked what would be the situation if a person acquired land legally and announce a housing society after getting approval from the CDA. He asked what would be next if the CDA issued a no-objection certificate to such society?

The case was adjourned till Thursday.

During the hearing of the case on Monday, the bench had remarked that land in all five zones of Islamabad could only be acquired according to the Capital Development Authority (CDA) Act. It also observed that the housing foundation was not mentioned in Islamabad’s master plan and that the CDA's regulations would be applied in societies established on its land. The court remarked that the Housing Foundation could launch a housing scheme itself.
