The Lahore High Court (LHC) on Monday disposed of a petition of Maryam Nawaz Sharif, Hamza Shahbaz and advised the petitioners to file an appeal against the Inland Revenue department who issued them notices for recovery of income support levy. Earlier the petitioner Hamza's lawyer contended before the court that the recovery of income support levy is violation of the country's law and constitution.
He said the Inland Revenue department lacked authority to impose and recover a tax in the name of social protection as after the passage of the 18th Constitutional Amendment social welfare is a provincial subject, he added. He argued that the federal government does not have the authority to pass any legislation on the social welfare of the public at large. The counsel asked the court to declare the impugned notice as illegal and unlawful.
