High Courts, sessions courts cannot hand over non custom paid vehicle: SC

ISLAMABAD: The Supreme Court on Wednesday remarked that the high courts and sessions courts cannot handover illegally imported non custom paid vehicles.

The division bench of the apex court, comprising Justice Ejaz Afzal Khan and Justice Qazi Faez Isa, heard the case filed by Customs against handing over of two illegally imported non custom paid vehicles to the owners in Dera Ismail Khan by the sessions court. The Peshawar High Court also maintained trial court verdict.

During the course of proceedings, the counsel for the Customs told the court that sessions court and high court had no authority to handover non custom paid vehicles to the owners as Customs Act applies. Later, the court after hearing arguments accepted the Customs appeal and void the Peshawar High Court verdict.
