IHC adjourns Ex-IG promotion case till 3rd week of May

ISLAMABAD: The Islamabad High Court adjourned the Intra Court Appeal (ICA) in connection with former Inspector General (IG) Police Islamabad, Aftab Ahmed Cheema's deferment till 3rd week of May with mutual consent of the litigants.

A division-bench comprising Justice Aamir Farooq and Justice Mian Gulhassan Orangzaib resumed the hearing of ICA filed by federal government.

During the course of proceedings, counsel for the Aftab Cheema apprised the court that his client going to be retired on May 11, 2016 so incompliance with single bench of Justice Shoukat Aziz Siddiqui order, Central Selection Board (CSB) should call its meeting within 15 days of the order but yet no such meeting was called, he added.

Additional Attorney General (AAG) Afnan Karim Kundi said that according to the rules Central Selection Board meeting could not be called within a month then how government could call it.

Kundi said that in bureaucrat promotion case, the division bench also maintained status-quo on the current situation dated September 15, 2015 so till the decision of the main case in which Cheema's petition was one of them, how government could promote an individual.

The bench observed that till the outcome of the reserved judgment on the main petition in the bureaucrat's promotion case CSB could not call the meeting due to status quo and suggested both litigants to wait till the decision of the main petition.

Subsequently, with the consent of the both counsels the bench adjourned the case till 3rd May.

It is pertinent to mention here that on March 28, 2016 single- judge bench of Justice Shoukat Aziz Siddiqui directed federation to grant proforma promotion to Aftab Cheema with 15 days while hearing the petition moved by Ex-IG Islamabad challenging his deferment due to an inquiry against him, however federation moved against the order and filed ICA.
