Intra-court appeals against land for Garments city dismissed

LAHORE: A Lahore High Court division bench on Tuesday dismissed intra court appeals against land acquisition for Garments City Sheikhupura.

The division bench comprising Justice Amin-ud-Din Khan and Justice Shahid Bilal Hassan was hearing the appeals filed by Anjuman-e-Mutasareen Garments City Sheikhupura and others challenging dismissal of their petitions against land acquisition for Garments City.

The petitioners through their appeals submitted that single bench dismissed the petitions on the ground that land was being acquired for a government company, Punjab industrial Estate and Management Company (PIEMC).

They submitted that land could be acquired for Public or even private company but the acquisition must be made for a public purpose only, as per law.

They contended that garments city was not a genuine public project and pleaded to set aside the single bench orders and direct respondents for holding inquiry as per section 40 of Land Acquisition Act.

However, Acting Advocate General Punjab Mustafa Ramday submitted that the appeals were not maintainable as the petitioner-organization was not registered.

He said that the government had authority to acquire land for welfare and development projects. He submitted that the Punjab industrial Estate and Management Company was owned by the government.

The bench after hearing the arguments dismissed appeals.
