ISLAMABAD: The Supreme Court on Wednesday dismissed the Interior Ministry's plea against Sindh High Court verdict for removal of former President Pervez Musharraf's name from the Exit Control List (ECL).
The five-member larger bench of the top court headed by Chief Justice Anwar Zaheer Jamali heard the case and in its short order dismissed the appeal.
During the course of proceedings, Pervez Musharraf's lawyer Farogh Nasim had requested the court to remove Pervez Musharraf's name from ECL as he was unwell and might suffer paralysis, therefore he should be allowed to visit abroad. Doctors had suggested his fusion surgery from abroad.
The court ruled that there was no legal bar on foreign travel by Musharraf unless he was stopped by the federal government.
The bench also disposed off Musharraf's application seeking one-time permission to proceed abroad for medical treatment on grounds that the petition was now infructuous. The apex court, however, did not stop the government or the special court trying the former president for high treason from placing his name on the ECL.
The bench remarked that the government could take additional legal measures to restrict or regulate Musharraf's movements.
The Chief Justice Jamali observed,"If the federation thinks Musharraf should not leave the country, then it should decide the matter itself."
Musharraf faces charges of treason for subverting the Constitution in late 2007 when he declared emergency rule and fired almost all the senior judiciary.
