ISLAMABAD: A three-member bench of the Supreme Court headed by Chief Justice Iftikhar Muhammad Chaudhary issued notice to Election Commission of Pakistan (ECP) and the Higher Education Commission (HEC) in MNA Ghulam Sarwar Khan and others and adjourned the hearing of the majority of cases for July 18, 2013.
The three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Ijaz Ahmed Chaudhry and Justice Gulzar Ahmed heard the cases regarding alleged fake degrees of various Parlialmentarians in detail and passed orders.
Election Commission of Pakistan and the Higher Education Commission have been asked to explain as to whether respondent Ghulam Sarwar contested the Election of 2008 by declaring himself to be a holder of BA degree; and the degree was a genuine or otherwise.
The learned counsel in the CMA further stated that for possessing a bogus degree as complaint was filed against him vide FIR No.67/2012 at Police Station ACE, Lahore and the matter is still pending before the learned Anti Corruption Court and bail before arrest (Crl. M. No.16724-B/2012) is pending before the LHC. In the meanwhile, the HEC shall call for documents from the respondent and verify the same and submit a report on the next date of hearing, the directed.
The Registrar of the HEC shall also obtain the report from LHC regarding pendency of his bail matter. Cases of Nawabzada Ghazanfar Ali Gull against Ch. Wajahat Hussain, MNA on account of fake degree, Application on behalf of Ch. Ghulam Qamar for taking action against Ghulam Sarwar Khan, MNA, on account of having fake degree, Application on behalf of Muhammad Atta Shah and others against Faisal Zaman, MPA, on account of having fake degree, Application on behalf of Faisal Javed against Rana Munawar Hussain, MPA, on account of having fake degree, Malik Muhammad Nawaz, MPA) Makhdoom Syed Ali Raza, MNA) Raja Shoukat Aziz Bhatti, MPA, In person, Mir Nadir Magsi, Karam Dad Wahla, MPA who appeared in person and Maiza Hameed besides some others were taken up.
The bench also discharged notice which was issued to Bilal Rehman as the learned counsel appearing for HEC informed the court that his (Bilal)documents had been verified, therefore, no further action is called for. Hearing of all the cases except Raja Shoukat Aziz Bhatti, Khawaja Muahammad Islam and Malik Nawaz were adjourned for July 19, 2013. However, cases of Shoukat Aziz Bhatti, Khawaja Muahammad Islam and Malik Nawaz were adjourned for July 9 (Tuesday).
