ISLAMABAD: The Supreme Court on Wednesday dismissed the review petition filed by contractors seeking refund of billions of rupees from the Federal Board of Revenue paid for tax.

A three-member bench of the apex court headed by Chief Justice Mian Saqib Nisar heard the case.

The court accepted FBR's stance over the matter and dismissed petition. During the course of proceedings, Akram Sheikh counsel for petitioners said Khyber Pakhtoonkhwa, FATA and PATA were given tax pardon for three years in 2010.

He said it was clearly mentioned in section 169 F of the Income Tax Ordinance that tax could not be recovered from war and natural calamity hit area.

Chief Justice Mian Saqib remarked that the court wanted rule of law in the country and everyone should feel happy after implementing law.

Hafiz Ahsan counsel for FBR said the companies which filed claims received full payments after completion of work.

He said the petitioner did not fall in the category of Income Tax Ordinance Section 169 F.

The court after hearing arguments of the case maintained high court order and dismissed the contractors' petition.
