imageISLAMABAD: The Supreme Court on Thursday reprimanded Inspector General of Islamabad Police Tahir Alam Khan for failure to arrest the accused involved in displaying banners against the higher judiciary judge and remarked that if police fails to make progress in the case, the court would issue proper orders in this regard.

The three-member bench of the apex court headed by Justice Ejaz Afzal Khan comprising Justice Ijaz Ahmed Chaudhry and Justice Mushir Alam resumed hearing of the suo-moto case regarding displaying of banners and placards against Supreme Court judge Justice Jawwad S. Khawaja in the federal capital.

The bench asked Islamabad Police to inform the court about latest investigation into the matter and expressed annoyance over police failure to trace the main culprit.

Justice Ijaz Ahmed Chaudhry remarked that whether the court would tell the police how to proceed and investigate a case. The Islamabad Police including its Inspector General (IG) despite clear cut court orders failed to investigate that who ordered to display banners in the capital against senior judge of the apex court, he observed.

The IG Islamabad told the bench that Police have arrested four accused involved in preparation of banners and displaying them on capital's busy roads and commercial centers. He said that police have written a letter to a spy agency for cooperation to trace the criminals and the agency officials shared verbal information and the police have asked them to share written information in this regard.

On a court query the IG told the bench that sections 501, 502, 504 and 505 of Pakistan Penal Code (PPC) were included in FIRs against the accused. The bench observed that all sections were bailable and non-bail able section was included in the FIR.

He said that police arrested accused Arshad who displayed banners against the apex court judge Justice Jawwad S. Khawaja. The accused admitted that he displayed banners against the superior court judge after watching `Khara Sach' program on ARY tv, the IGP said. The IGP stated that main accused Arshad got bail and the police had contacted Islamabad High Court (IHC) and the IHC gave decision against the police.

He said the accused was in contact with Mubashir Luqman and other journalists and the accused admitted that he displayed banners after getting inspiration from Mubashir Luqman's program. He said that police tried to investigate Mubashir Luqman but he got bail.

On this Justice Ijaz asked the IG that whether the IHC order is important or the Supreme Court? He remarked that IHC had issued an order and the police was telling stories before the court. He remarked that why the court has not issued contempt of court notice to the IGP for failing to comply court orders.

The court also expressed annoyance over police investigation report and observed it seemed that police does not want to investigate the case on merit. "Why a security agency could display banners against the Supreme Court judge and what kind of motives they could have behind this act", Justice Ijaz questioned and remarked that some people use agencies names to divert attention. He said it was duty of the police to safeguard the rights of people but the capital police along with its IG failed to fulfill its constitutional obligations.

He said that police submitted reports on January 1 and February 12 but it seemed that investigation officer and his team did not want to investigate the case in proper manner.

The hearing of the case was adjourned till April 8.
