ISLAMABAD: Islamabad High Court (IHC) on Thursday reserved its decision in a plea challenging the death warrants issued by Anti-Terrorism Court in a triple murder case.
The two member divisional bench of IHC heard the petition filed by Zulifqar, who was earlier declared convict in a triple murder case and later ATC Islamabad issued his death warrants.
The counsel for the petitioner Rana Ishfaq informed the court that earlier the ATC Rawalpindi announced death penalty to his client but later ATC Islamabad issued his death warrants.
He adopted the stance that accordance to the law, only the same court was authorized to issue death warrants, which had earlier announced death penalty to his client Zulifqar.
However, the Advocate General informed the court that ATC Islamabad had issued death warrants of convict Zulifqar under the rules and law and prayed the court to set aside the stay order over implementation of death warrants. After hearing the arguments from both sides, the court reserved its decision over stay order on death warrants and adjourned hearing of the case.
Meanwhile, the same bench also reserved a decision over a plea filed by a convict Raees Ahmad who also announced death sentence in a murder case by ATC Rawalpindi.
This is to mention here that during last hearing, the court had asked the Advocate General Mian Abdul Raof to submit the notification for establishment of ATC-2 Islamabad. The notification was also presented to the court during the hearing.
