A petition has been filed in the Supreme Court against Chairman National Accountability Bureau (NAB) former Justice Javed Iqbal for issuing a press release, which had stated that former Prime Minister Nawaz Sharif had allegedly laundered $4.9 billion to India. President of the Pakistan Muslim League-Nawaz's Japan chapter, Noor Muhammad Awan, filed a petition under the Article 184(3) of Constitution and made NAB Chairman former Justice Javed Iqbal as respondent.
Awan said the chairman NAB on 18-05-18 issued a press release, which stated that former Prime Minister Nawaz Sharif had laundered $4.9 billion to India. It was alleged in the press release that information was revealed through the World Bank's Migration and Remittance Book for the year 2016.
The petitioner said that State Bank of Pakistan had denied this news item in its press release on 21-09-2016. He said before issuing the press release the NAB should have investigated the matter thoroughly. He said through the press release, the independence of institution stands damaged, malice is floated from the conduct, impartiality is vanished and oath has been defiled.
"With all due respect, the careless press release cannot be said a bona fide act as a person steering an institution as retired judge of superior judiciary and having well equipped knowledge and responsibility. He is supposed not to make himself or institution in a despotic fixed situation or to cause distrust or to lose the credibility of the institution which is done by the respondent, which goes against him for all grounds to be removed as being incapable to hold the office." The petitioner said.
He said that the apex court always took notice of illegalities, irregularities and intervened in the situations when holder of a public office liable to be adjudged in the Article 184(3) of Constitution was found guilty.
"This is one of the exceptional situations to intervene when press release is not supported by any sound material rather a flimsy press release shows grudge for all this time, past and future, there is no likelihood, if this gentleman holds the office, of being free and fair from the rivals of ex-prime minister or to work independently. The removal is inevitable to meet the ends of justice," he said. He further prayed that chairman NAB kindly be removed as being ceased to hold office due to "partiality" and unable to work with fairness.
