ISLAMABAD: The Islamabad High Court (IHC) Tuesday directed the Capital Development Authority (CDA) to implement the agreement regarding provision of land for Birds Aviary in Lake View Park within a month.
IHC's Justice Shaukat Aziz Saddiqui heard the contempt of court petition against CDA filed by Bird Aviary owner Muhammad Saeed.
During the course of proceedings, the CDA's Member Planning assured the court that the department would give remaining three acres land to the petitioner in accordance with the agreement within a month. He, however, said that the development work on the land would be done by the petitioner himself.
Hafiz Arafat, counsel for the petitioner, contended that under the agreement signed five years ago, the CDA was bound to give seven and a half acres land for the bird aviary. The Authority had given only 4.5 acres land so far and was not implementing the agreement despite the IHC orders, he added.
He argued that precious birds had been imported from abroad to provide recreation to the residents of federal capital, but a big number of them had died due to shortage of space. His client had incurred due to the non-implementation of the agreement, he added.
The court directed the CDA to submit a report after implementing the agreement.
