The Federal Board of Revenue (FBR) has directed the Chief Commissioners of Large Taxpayer Units (LTUs) of Karachi Lahore and Islamabad to submit their proposals to ensure uniform treatment in refund cases to the permanent establishments of foreign companies under avoidance of double taxation conventions.
Sources told Business Recorder here on Tuesday that the FBR has decided to convene a meeting on the uniform treatment to the permanent establishments of foreign companies at the FBR House on January 27. The meeting would be attended by FBR Member Inland Revenue (IR), FBR Member Legal, Chief Commissioners of LTUs and some heads of the RTOs including Chief Commissioner RTO Peshawar.
The meeting will be held following the directives of the Federal Tax Ombudsman (FTO) to formulate a uniform policy regarding assessment of income and admissibility of refunds in cases of permanent establishments of foreign companies. The FBR should direct the Chief Commissioners to decide the cases of permanent establishments of foreign companies fairly and uniformly, FTO office added. Accordingly, the FBR had directed the field formations to decide the cases of the permanent establishments of foreign companies in accordance with the prevalent provisions of law and double taxation agreements.
