Chairman Judicial Activism Panel Azhar Saddique has said the Supreme Court should ask President Asif Ali Zardari to deposit as much amount with the court as 'being kept' in Swiss banks accounts for claiming his immunity. Addressing a press conference, Azhar said court should give immunity to the president against the surety deposited with the court.
Commenting on the statement of Ch Aitzaz, he said he was a leader of lawyers' movement and should continue to work for the independence of judiciary. He said former Justice Ramday did not pass any comment, but only quoted the Supreme Court verdict. If anyone had any objection, he should file an appeal against it, he added.
Azhar said Aitzaz himself had pleaded against the immunity in a case of General Musharraf, who had sought immunity from the Supreme Court and which was rejected. He said the Supreme Court in Wattan Party Vs Federation of Pakistan had already declared that if anyone did not seek immunity, he had to act under article 5(2) of the constitution.
Azhar quoting the NRO and judges' appointment cases said Supreme Court could examine all type of cases even barred by the constitution. He said the present parliament had not pass the NRO and proved that it was against the corruption. Therefore, the looted money should bring back to Pakistan, he added.
