A bench of the Supreme Court (SC) here on Friday set aside 15 years imprisonment handed down to Faqir Muhammad and Ramzan for cutting nose, lips and sensitive part of a man awarded by a sessions court. Bench comprising Justice MA Shahid Siddiqui and Justice Asif Saeed Khan Khosa accepting the appeals observed that it is a case of sudden provocation, as Hanif entered into house of accused persons late at night with nefarious designs.
The bench said, as the incident took place in a rural area where people usually react violently in the name of honour. Fariq and Ramzan were accused of cutting nose, lips and sensitive part, as he had forcibly entered into their house to fulfil his nefarious design. Sessions's court at Dera Ghazi Khan had awarded them 15 years imprisonment each in different offences and Lahore High Court had dismissed their appeals. Apex court, however, accepted their appeal and acquitted them.
