People's Lawyers Forum (PLF) here Monday assailed the Lahore High Court judgement in the dual office case against President Asif Ali Zardari terming it unconstitutional and a continuation of the anti-PPP mindset in judiciary. While addressing a press conference Central Secretary General PLF Muhammad Ilyas Khan here on Monday, said the judicial murder of Zulfikar Ali Bhutto was the result of the same mindset besides the murder of Benazir Bhutto Shaheed and other leaders and workers.
Flanked by other officer bearers of the People's Lawyers Forum (PLF) he said the LHC decision in the dual office case was unconstitutional as the constitution allows every citizen to take part in politics. He said that president of Pakistan could not be barred from keeping a political office or taking part in politics under any section of the constitution.
He said that the bench in its decision had also admitted that political activities of the president could not be termed unconstitutional. "We believe that a writ petition could be filed under Article 199 of the constitution only when fundamental rights of anyone were being infringed," he added.
Ilyas Khan said that in this case rights of any person were not being infringed, therefore, a writ could not be issued. He said that Asif Ali Zardari was co-chairperson of PPP when he filed nomination papers for the president but no one raised objection on nomination papers as the constitution did not bar it. He said that being head of a political party how he could keep neutrality. He took part in elections on political basis and was elected, therefore, it was his constitutional right to take part in politics," he added.
