Chief Justice of Lahore High Court, Ijaz Ahmad Chaudhry, on Monday while dismissing as being premature the petitions filed in relation to the issue of immunity to Raymond Davis observed that Pakistani courts cannot issue any writ against American authorities.
Hearing a petition filed to seek impleading of the US government as necessary party in a case against the diplomatic immunity to the double-murder accused Raymond Davis, the chief justice said the moot question was whether America recognises jurisdiction of the Pakistani courts to accept their writ or our courts could issue writ against America.
The court remarked the question whether or not Davis enjoyed diplomatic immunity has to be answered by the Ministry of Foreign Affairs and the US may come into picture in light of what stand the ministry would take on the issue.
The petitioner, on the other, maintained that efforts were afoot to take Raymond case to the International Court of Justice (ICJ) despite the fact America in 2005 had given up jurisdiction of the international court therefore direction may be given to the authorities not to concede to any demand to take the matter to the ICJ. The petitioner contended Pakistani courts do not have embargo on their jurisdiction to look into the matter even if the matter is decided in favour of diplomatic immunity to the accused. The court, however, termed fears of the petitioner unfounded at this stage and rejected his prayers.
