Sindh High Court on Wednesday cautioned petitioner Advocate Syed Iqbal Kazmi to appear on next date to proceed May 12, 2007 carnage petition, otherwise, case may be dismissed.
A division bench, headed by Chief Justice Mushir Alam, was hearing miscellaneous applications filed in main petition against Pervez Musharraf, MQM Chief Altaf Hussain, then Secretary Interior Ministry, then Sindh Home Minister Waseem Akhtar, then Sindh Chief Minister Dr Arbab Ghulam Rahim, then Home Secretary Ghulam Mohammad Mohtaram, then Sindh Police Chief, then DG Sindh Rangers, then Karachi Police Chief & then SHO City Courts police station, Karachi.
He alleged MQM was involved in mayhem in Karachi, in which over 50 people were killed and many injured in armed clashes. Another miscellaneous application requested for recalling order passed on November 11, 2007, wherein petitioner was allowed to withdraw his petition by SHC full bench.
On Wednesday, Deputy Attorney General Nazar Akhbar and Additional AG Sarwar Khan were present, but petitioner Syed Iqbal Kazmi was absent. SHC division bench ordered: "This petition was dismissed as withdrawn vide order dated November 19, 2007. It appears application, including other applications for recalled order referred to above are pending but none had appeared on behalf of petitioner today. The matter is being adjourned with caution that on next date of hearing, if none appears, all listed applications may be dismissed for non-prosecution." Hearing was adjourned for three weeks.
