imageISLAMABAD: The Special Court trying former President Gen. (retd) Pervez Musharraf under high treason act of the Constitution for abrogating and subverting constitution by proclaiming emergency in the country on Wednesday adjourned its hearing till Thursday.

The three-member bench headed by Justice Faisal Arab comprising Justice Yawar Ali and Tahira Safdar resumed hearing of the high profile treason case.

During the proceedings, Defence counsel Farogh Nasim cross-examined witness Maqsood-Ul-Hassan, Director Federal Investigation Agency (FIA) and questioned that did FIA get permission from the competent authority to start inquiry and investigation against the former President.

Maqsood-ul-Hassan informed that FIA does not need prior permission to lodge FIR or initiate inquiry as according to Criminal Act FIA can start investigation and inquiry without lodging First Information Report (FIR).

Replying to a question, he said that FIA has found no evidence against then Prime Minister, cabinet members or services chiefs that they were involved with former President Pervez Musharraf in proclamation of emergency.

He said that former Chief of Army staff Gen. Ashfaq Pervez Kiayani could not be declared as aider and abettor in proclamation of emergency.

Farogh Nasim also submitted an application before the bench to include names of former Prime Minister Shaukat Aziz, then Services Chiefs and other important people in the case.

The prosecution team objected the application and said that the application was not according to law and the court cannot entertain any application at this stage.

The court directed the prosecution to submit reply till Thursday and adjourned hearing of the case.
