A constitutional petition filed in the Supreme Court has urged the court to issue directives to government to publish and disseminate details of agreements with US/Nato and Isaf forces, enabling citizen of Pakistan to take appropriate measures in the national interest as well as for their own security.
Maulana Samiul Haq, Jamiat Ulema Islam (Samiul Haq) Group chief being chairman Pakistan Defence Council on Tuesday filed the petition through his counsel Muhammad Muazzam Butt under Article 184(3) of the Constitution. The petitioner made as many as 13 respondents, including, secretary to the President, principal secretary to the Prime Minister, secretaries of Defence, Interior and foreign affairs, secretaries of all four governors and chief secretaries of all four provinces.
According to Maulana Haq, a total of 2634 citizens were perished in 227 drone attacks from 2004 to 2011. He urged that under Article 9 of the Constitution it is the duty of the federation to protect and provide security to citizens. Grant of permission to the US and Nato forces to launch drone attacks was a violation of fundamental rights of citizens.
It was also contended that the copy of the agreement through which the government allowed Shamsi Airbase to be used by the US government for launching strikes and operations inside and outside Pakistan may also be handed over to the print and electronic media. The petitioner requested the government to refrain from allowing the use of air space, land and territory to any other state or country's armed forces. The Maulana pleaded that the parliament may formulate a policy for providing country's space, area, land and territory to another state if it is inevitable.
