Sindh High Court Thursday directed the law officers of Sindh government, City District Government Karachi and Trading Corporation of Pakistan to argue on December 24, 2010 whether the price of sugar fixed by public functionaries could be challenged in extra ordinary jurisdiction in high court.
A division bench, comprising Justice Mushir Alam and Justice Aqeel Ahmed Abbasi, was hearing four identical petitions filed by sugar importers. Their counsel Sami Ahsan submitted that his clients imported refined sugar from India, Brazil, Thailand and UAE at higher price. Sugar stocks were lying in godowns of Passco in Korangi, Karachi.
He submitted that Sindh government was forcing them to sell imported sugar at lower rates than their purchase cost. He prayed to restrain government functionaries from interfering with sugar stocks of petitioner importers. Advocate Mazhar Jaferi filed power on behalf of TCP, while TCP GM (Legal) Ghulam Abbas also appeared. Advocate Manzoor Ahmed for CDGK and AAG Miran Muhammad Shah for Sindh government appeared.
SHC division bench directed all counsels to come prepared as whether price of sugar fixed by public functionaries could be impugned or challenged by way of Extra Ordinary Jurisdiction and whether petitioners have any right to challenge the authority to fix price of sugar. Continuing interim order passed earlier, bench adjourned hearing till December 24, 2010.
