The Supreme Court on Thursday annulled the election to the Punjab Provincial Assembly seat from Lahore and ordered the election commission to organise new polls in the constituency known as PP 156.
The seat was contested between Sheik Amjad Aziz and Haroon Akhtar and in the results announced immediately after the polls former was declared elected.
On an election petition, however, the Punjab Election Tribunal unseated him on the ground that his educational qualifications were questionable and declared Haroon Akhtar as elected to the Provincial Assembly.
The First Bench handed down the orders of annulment after a day long hearing. Raja Anwer and Raja Shafqat Abbasi represented Amjad Sheikh while Qayyum Muhammad Malik assisted by Umer Atta Bandial and Muhammad Raza appeared for Haroon Akhtar.
Amjad Sheikh's counsel contested the allegation of "fake educational degree" against Amjad Aziz Sheikh saying that it was repudiated by an Inquiry Committee of the University by verifying his graduation results.
Qayyum Malik had, however, contested the argument on the ground that degree produced by Amjad Sheikh was dated a little earlier than the general elections of 2002 while he claimed to have passed the examination some eight years ago.
The First Bench is composed of Chief Justice Nazim Hussain Siddiqui, Justice Javed Iqbal and Justice Abdul Hameed Dogar.
