LAHORE: The Lahore High Court Wednesday sought reply from Inspector General of Police Punjab within two weeks on petition seeking quashment of FIRs registered in connection with dengue larva.
Justice Sardar Muhammad Shamim Khan passed the orders on a petition filed by petitioner counsel Muhammad Saad Khan.
Earlier, the petitioner-counsel arguing before the court submitted that prevention or control of dengue was important but such prevention through the police with authority to lodge FIRs under section 154 was nothing but abuse of power.
The petitioner referring a FIR submitted that offences were reported under Punjab Epidemic Disease Act 1958 (PEDA), Punjab Prevention & Control of Dengue (Temporary) Regulation 2011 (PPCDR), Penal code sections 268 and 270.
However, he contended, that the PEDA provides for single offence punishable under section 168 whereas PPCDR had been repealed since December 16, 2011.
He termed the registration of FIRs in dengue cases illegal and pleaded the court for directions to quash such FIRs.
The court after hearing the arguments issued notice and sought reply from the IGP within two weeks.
