ISLAMABAD: Islamabad High Court (IHC) Tuesday turned down the decision of Election Commission of Pakistan (ECP) for disqualifying a lawmaker named in ‘fourth schedule’ under Anti Terrorism Act.

The court decided that the ECP was not authorized to disqualify any member of National Assembly named in ‘fourth schedule'.

Justice Aamer Farooq announced a short order on a petition filed by a member provincial assembly (MPA) from Khyber Pakhtunkhwa (KP) Shah Muhammad.

On Sepetmeber 21, 2017, the ECP had disqualified a MPA Shah Muhammad and member District Council Bannu Gulbaz Khan due to being placed into forth schedule.

The MPA had moved a petition to the IHC through his counsel Dr Baber Awan challenging the decision of ECP.
