imageISLAMABAD: The Islamabad High Court on Friday issued notice to the Managing Director of Oil and Gas Development Company Limited (OGDCL) to appear and explain that why payment of Rs 125,245,185 was not paid to Bugti family.

A single Judge bench comprising Justice Shoukat Aziz Siddiqui issued the directive while hearing a plea filed by Shah Zain Bugti through his lawyers Dr. Babar Awan,seeking direction to get an amount of gas royalty from OGDCL.

During course of hearing, Babar Awan apprised the bench that the petitioners is the Grand son of Late Shaheed Nawab Akbar Khan Bugti and has given a portion of 3207 acres land on lease to the OGDCL for producing natural gas.

According to clause 1 of the lease agreement the payments for the second and third year were to be made in January 2013 and January 2014, respectively, he added.

All the other payments have already been made, however the payment of Rs 125,245,185 which is due from January 2014 has not been made by the OGDCL to the petitioners till today, which is clear violation of the terms of agreement and promises of respondent as well as the promises of the government of Baluchistan, Babar maintained.

He contended that it is the legal and contractual obligation of the respondents to pay the agreed amount to the petitioners.

The Act of the Respondents is in violation of the constitutional guarantees and fundamentals rights protected under Article 23 and 24 of the Constitution, Babar added.

He prayed the court to direct OGDCL to pay the agreed amount to the petitioners without any further delay.
