ISLAMABAD: The Supreme Court on Thursday dismissed a petition filed by Muhammad Hussain Mehnati, Ameer Jamaat-i-Islami (JI), Karachi regarding the rigging in the mega city during the general elections.
The three-member bench comprising Chief Justice Iftikhar Muhammad Chaudhry, Justice Ijaz Ahmed Chaudhry and Justice Gulzar Ahmed heard the constitutional petition filed by Mehnati under Article 184 (3) of the Constitution.
The Chief Justice remarked that how a political party, which did not take part in the election, could raise finger on its results.
The counsel for Mehnati stated that the JI boycotted the polling in the port city on the very same day due to lot of complaints regarding the alleged rigging.
The CJ asked that how could a political party, which had boycotted the polling process, ask for its reversal.
"You are the person, who boycotted the election and now you are seeking a remedy," he added.
The bench noted that Article 184 (3) could not be evoked when a party had boycotted the elections and dismissed the petition.
It may be worth mentioning that Article 184 of the Constitution is about the original jurisdiction of the Supreme Court, while the Article 184 (3) states the Supreme Court can make an order in a matter where there is a matter of the enforcement of fundamental right.
