Restraining the federal government from taking any action against incumbent police chief of Sindh province, Supreme Court Thursday declared that AD Khawaja will have the authority of transfers and postings in the department. Accepting the Sindh government's appeal for hearing against Sindh High Court verdict in the matter, Chief Justice Mian Saqib Nisar while heading a three-member bench said that the federal government's action has nothing to do with appointment of head of Sindh Police till final adjudication of the matter in the apex court.
Appearing on behalf of Sindh government, Farooq H Naik argued that Sindh High Court has declared Police Act 2011 valid and authorized AD Khawaja to make appointment, to which the Chief Justice appreciated the SHC decision.
Naek pleaded that high court had given relief which was not sought by the petitioner (AD Khawaja), saying high court doesn't have suo motu power. However, Chief Justice Mian Saqib Nisar promptly responded but the Supreme Court has this power. Stopping Advocate General Sindh from delivering arguments in the case, the Chief Justice said that the provincial government by engaging Farooq H Naek has lessened the importance of provincial law officer, adding in presence of Naek's arguments advocate general Sindh can't plead Sindh government case.
Responding to Naek's request to specify next date of hearing, the Chief Justice said the court will take up the matter soon and adjourned the hearing for indefinite period.
