The federal government has reportedly decided to withdraw appellate powers from the National Electric Power Regulatory Authority (Nepra) by establishing a full-fledged independent appellate tribunal for the power sector.
The Power Division and other power sector entities were making a hue and cry for long time on this issue, saying that Nepra should not be the appellate authority of its own decisions.
Section 12 A of the Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Act, 2108 states that the Federal Government shall by notification in the official gazette, establish an appellate tribunal for the purpose of exercising jurisdiction under Nepra Act.

Section 12 A of the Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Act, 2108 lays down that the Federal Government shall by notification in the official gazette, establish and appellate tribunal for the purpose of exercising jurisdiction under Nepra Act.
The tribunal will have 24 posts, approved by Finance and Establishment Divisions. The Prime Minister has accorded approval for creation of the posts of Chairman and two members in MP-1 and MP-II scales, respectively for the tribunal.
The sources said, the tribunal will be headed by Chairman, who will be assisted by Member (Finance) and Member (Electricity) along with 21 supporting staff. An amount of Rs 15,052,000 is required with effect from April 1, 2020 to June 30, 2002 during the current financial year i.e. 2019-2020 to meet the expenditure involved for establishment and functioning of appellate tribunal under section 12A of the Regulation of Generation, Transmission and Distribution of Electric Power (Amendment) Act, 2018.
In pursuance of schedule-II of Rules of Business, 1973, the establishment of appellate tribunal and all ancillary matters thereof is the subject of Law and Justice Division.
The Ministry of Law and Justice has sent a summary to the Federal Cabinet for approval in terms of section 12A of the Regulation of Generation, Transmission and Distribution of Nepra Act 2018. The appellate tribunal will be established at Islamabad having jurisdiction in whole Pakistan.
