LAHORE: A Lahore High Court division bench on Tuesday adjourning hearing of an appeal against acquittal of Mustafa Kanju and others in Zain murder case till December 28 sought DNA report of victim's blood stains found in Kanju's car.
The bench headed by Justice Shahid Hameed Dar was hearing an appeal filed by provincial Prosecution department.
During the hearing, Prosecutor General Punjab Ehtesham Qadir arguing before the court submitted that the trial court acquitted the accused after retraction of some witnesses.
He submitted that the trial court failed to record statements of the investigation officer, recovery officer and other officials which was mandatory. He further said that the trial court did not give fair opportunity for cross examination of the witnesses.
He said that Mustafa Kanju's accomplice shifted Zain to car in injured condition and samples of his blood stains found in car were sent to forensic laboratory for DNA analysis but the report was still awaited.
However, the trial court acquitted the accused despite the fact that the report was awaited, he added.
At this, the court criticised the performance of prosecution and submitted that it should produce this report timely.
The court allowing time for submission of DNA report adjourned the further hearing till December 28.
