ISLAMABAD: The Supreme Court on Tuesday directed Secretary Interior to present seek leave notification of Major-General Ijaz Shahid Inspector General Frontier Corps (FC) by December 11. A three-judge bench headed by Chief Justice Iftikhar Muhammad Chuadhry comprising Justice Jawad S Khawaja and Justice Amir Hani Muslim also directed him to produce the relevant record of his admission at Armed Forces Institute of cardiology (AFIC).
The bench instructed Munir A Malik Attorney General (AG) to get the record of Shahid's admission at AFIC personally to present before the apex court as well.
During the course of proceeding, Chief Justice asked AD that who is the competent authority to grant leave IG FC and whether it was a written application for leave or oral. AG informed that Secretary Interior was the competent authority and the request for leave by the IG FC Balochistan was made orally. Chief Justice inquired AG if there was a leave notification then court also want to know the notification date in addition.
Meanwhile CJ asked about the appearance of DIG FC as he was summoned by the apex court and who may command after IG FC. AG apprised the bench that he was on his way to the Supreme Court and likely to appear before the bench. But even after passing long time DIG FC could not appear before the court. Chief Justice remarked that Baloch families traveled on foot from Quetta to Karachi demanding to produce their missing persons, they walked for their beloved ones' and not for foods, he added.
Chief Justice said that time Defence Ministed visited the camps at Karachi and assured the campers that their problems would be solved till December 10. Subsequently,the date given by Defence Minister was passed,so AG is required to present the details whether the problem of campers were resolved or not yet.
Later the bench adjourned further hearing of the case till December 11.
