imageISLAMABAD: The Supreme Court on Tuesday declared the appointment of Director General Civil Aviation Authority (CAA) Air Martial (retd) Khalid Chaudhry as void ab initio and of no legal consequence.

An 82-paged detailed judgment released by the apex court also rejected the notification of the appointment of Khalid Chaudhry dated July 18, 2012.

The judgment, authored by Chief Justice Iftikhar Muhammad Chaudhry, stated that the appointment of DG CAA was not transparent and according to the law and did not fulfill the legal requirements and directed the federal government to appoint new DG as early as possible.

The apex court also directed the federal government to ensure that all the legal requirements were fulfilled while appointing the new DG CAA.

"The project of New Benazir Bhutto International Airport Project, Islamabad (NBBIAP), prima facie suffers from illegalities, irregularities, corruption and corrupt practices and the delay caused in its completion on account of illegal deeds, omissions and commissions of the consultants Louis Burger and all other concerned persons, who were responsible for selecting the site, preparing the designs and also awarding contracts to the contractors."

The court also directed to the DG Federal Investigation Agency (FIA) to supervise the inquiry himself and to complete the same expeditiously regarding the persons involved in the delay of the completion of NBBIAP.

It directed the federal government to complete the remaining work of the airport as early as possible as the cost of the project would raise with every passing day.

"As regards report of the Auditor General in respect of over-payment of Rs 1556.47 million is concerned, this audit so far has not been removed, therefore, LTH (JV) is required to deposit this amount with the exchequer within a period of seven days subject to intimation to the Registrar for our perusal in our chambers."
