ISLAMABAD: The Supreme Court on Tuesday dismissed a petition regarding the appointment of armed forces' chiefs saying that it was based upon hypothesis and did not carry any weightage.
Petitioner Shahid Aurakzai had pleaded that the appointments of Chairman Joint Chiefs of Staff Committee, Army Chief, Naval Chief and Air Chief should not be interlinked with seniority.
A three-member bench headed by Justice Anwar Zaheer Jamali heard the case and rejected the petitioner's stance, terming it "immature".
The bench observed that the petition had no solid grounds as at the time of its filing, the current prime minister was only a member of the National Assembly and all the four posts were already filled.
Justice Asif Saeed Khosa remarked that even the Islamabad High Court had dismissed the petition on the basis of hypothesis. The court observed that it was the prerogative of state to appoint chiefs of the armed forces.
