LAHORE: The Lahore High Court Monday sought arguments on maintainability of the petition seeking directions to restrain Election Commission of Pakistan (ECP) from issuing schedule of elections for the post of Pakistan Cricket Board (PCB) chairman.
Justice Nasir Saeed Sheikh passed the orders on a petition filed by Sayid Aizad Hussain, Chairman of Interim Committee of Lahore City Cricket Association.
Earlier, the petitioner's counsel arguing the matter submitted that a single bench of Islamabad High Court (IHC) ordered to hold elections for Chairman PCB post while declaring amendments made in PCB constitution illegal, on a petition. However, the respondents moved an intra court appeal in IHC against the order and it was still pending, he said.
Meanwhile, the IHC single bench ordered ECP to hold elections for post of chairman PCB on November 2, while hearing a contempt petition filed against non-compliance of earlier court orders.
He pointed out that electoral college for elections of Chairman PCB post consist of 111 members and 82 members were presently working whereas remaining members were not available due to various reasons.
The counsel said that the petitioner was eligible to contest the chairman PCB elections but he could not participate in the elections as Lahore zone elections would be held on November 29.
He said that the petitioner would be deprived of his right to contest the elections, if the elections were held on November 2.
He further contended that the case fell in the jurisdiction of the Lahore High Court as the PCB headquarters were located in Lahore.
He pleaded the court to restrain ECP from issuing schedule for elections of chairman PCB post in view of incomplete electoral college.
He pleaded the court to issue directions that the schedule should be announced after completion of electoral college.
After hearing the arguments, the court ordered PCB's counsel to seek instructions whether the petitioner had moved application in pending appeal before IHC.
The court directed petitioner's counsel to file a copy of reply of respondents before IHC and also forward arguments on maintainability of the petition on October 30.
