PHCBA dissatisfied over recommended names of judges to JCP

Expressing dissatisfaction over names for positions of judges, recommended to Judicial Commission of Pakistan (JCP), the Peshawar High Court Bar Association (PHCBA) termed the proposed names allegedly against merit, and demanding to ensure merit in appointment of judges at the superior court.

Addressing a news conference at Press club here on Saturday, the PHCBA president Esa Khan said that a judicial commission was constituted for appointments and postings of judges a some five year back, which he termed, it as 'so-called' commission. He said the all rights have been given to chief justice of relevant superior court. Currently, he alleged the right is misusing at the Peshawar High Court, as it recommended only five names for appointment of only five judges to the Judicial Commission of Pakistan. The commission, he said accepted the recommendations of Chief Justice of PHC. He, however, said the merit was allegedly completely ignored in this regard.

Accompanied by the association General secretary Ayaz Khan, vice president Jamal Khan Afridi and others, Esa Khan further accused the five names have been proposed out of which one belonging from Chief Justice Peshawar high court chamber, second from Abbottabad, third hailing from D.I.Khan, which he said, were class-fellow of the present and former chief justice of the Peshawar high court.

PHCBA president said the association would soon organise a lawyers' convention, in which the issue of appointments of new judges in Peshawar high court, would be raised. In 2007, he said a lawyer movement was started from Peshawar, which later converted into safe judges' movement, through which legal fraternity received colossal damaged. He, however, warned that if the proposed names were not review and demands were not accepted, then they would soon launch a safe judiciary movement, and set up a sit-in outside PHC.

General Secretary of association, Ayaz Khan said that previously most competent five judges name Abdus Samad, Sher Muhammad Khan, Zia-ur-Rehman Khan, Sardar Shaukat Hayat and Imtiaz Khan were not confirmed by the then Chief Justice of Peshawar High Court and after that such like appointment favourable to the CJ, which totally harm to dignity and decorum of PHC.
