President's dual offices: LHC registrar's office returns petition

The Lahore High Court (LHC) registrar's office here on Tuesday returned a constitutional petition seeking direction to restrain President Asif Ali Zardari from holding his office allegedly for violating of the Constitution and his oath. Registrar's office has put an objection on the petition that the matter relates to Islamabad therefore, Islamabad High Court is the proper forum to agitate the issue.

A citizen Hafiz Muhammad Asim has filed the petition and also sought interpretation of Article 47 of the Constitution after a recent statement of the President wherein he said, "If Article 47 is invoked, he would not accept the Constitution." Petitioner termed the statement a high reason within the meaning of Article 6 of the Constitution.

Petitioner pointed out that in view of the oath, as prescribed in Article 42, the President would perform his duties honestly in accordance with the Constitution and law, and always in the interest of the sovereignty, integrity, solidarity, well being and prosperity of Pakistan, so he had not only violated the oath but had disregarded the Constitution.
