imageISLAMABAD; The Supreme Court on Tuesday maintained that exclusive relaxation might be taken from the prime minister for the establishment of a housing society for the lawyers in the capital city.

This was stated by a three-judge bench headed by Chief Justice Iftikhar Muhammad Chaudhry during the hearing of a case regarding the establishment of a housing society for the members of Supreme Court Bar Association of Pakistan (SCBAP) as announced by the former Prime Minister Raja Pervaiz Ashraf.

During the course of proceeding, Shah Khawar, Additional Attorney General (AAG) apprised the court that a sum of Rs 50 million has been sanctioned which would be provided within a couple of days for the construction of a lawyers? complex.

As far as the establishment of a housing society for SCBAP members was concerned, he stated that a summery had been finalized by the law ministry.

He maintained that, however there was no provision in the by laws of Capital Development Authority (CDA) for providing land to a private housing society.

The bench remarked that there should be some provision for the acquiring of land as the lawyers themselves could not afford to acquire land in the federal capital.

Shah Khawar maintained that land in the capital could only be purchased by the Federal Government Employees Housing Foundation (FGEHF).

He apprised the court that the government was very sincere in materializing this concept adding that some time might be needed as the prime minister was abroad during the last few days.

Chief Justice Iftikhar Muhammad Chaudhry remarked that the housing project should be exclusively for the lawyers of SCBAP and no other should be given a chance to take benefit from the society.

The CJ further maintained that only deserving candidates should be incorporated in the housing society who could not afford houses in the capital.

The bench stressed that fairness should be ensured during the allocating of plots in the housing society.

The bench inquired about the location of the establishment of housing society, upon which the AAG replied that phase IV near Bhara Kahu could be one of the places for the purpose.

The bench maintained that there should be any other place for the society such as Sector F-14 could be the best place for establishing this society.

The bench in its order maintained that though there was no provision of establishing a housing society in the capital, the relaxation should be sought from the prime minister for acquiring land from the CDA.

Later, the court adjourned further hearing of the case till November 21.
